ICYMI: Judge Dismisses Activist’s Lawsuit Against Michelle Fischbach, Justice & Drew #TCNT

Last Thursday morning I was on with Justice & Drew to discuss a story from MinnPost regarding the hearing held in the lawsuit brought by a DFL activist against State Senator Michelle Fischbach seeking a declaratory action that Senator Fischbach cannot simultaneously serve as State Senator and Lt. Governor.  You can listen to our February 1 discussion here.  For additional background on the legal issues surrounding this matter you can read this post which contains our prior discussion and links to pertinent cases.

On Monday, Judge John Guthmann issued an order which granted Senator Fischbach’s motion to dismiss the case – which I predicted he would do last Thursday, citing, in part, as I predicted he would, the Minnesota Supreme Court’s ruling in the Legislature’s lawsuit against Governor Dayton which held that the dispute was political and not one that the courts should be called to resolve.

Not exactly Babe Ruth calling his shot, but I’m fairly impressed with my skills as a legal commentator.  Thanks to Jon, Drew and Sam for having me back on Tuesday morning following Judge Guthmann’s order to do a victory lap of sorts.
