Will SCOTUS Set the January 6 Defendants Free?, Jon Justice, 4.18.24
On Wednesday morning, I called in to Jon Justice’s morning show to discuss the U.S. Supreme Court oral arguments in a case involving Joseph W. Fischer, a Jonestown, Pennsylvania man who has been charged in connection with the January 6, 2021 kerfuffle at the U.S. Capitol. At issue is whether the prosecutors are using an overly broad interpretation of 18 U.S. Code Section 1512(c) – an Enron-era obstruction law – in their charging January 6 defendants. As we discussed during the show, a majority of the Justices – six to be exact – appear to be leaning to answering that question in the affirmative. If that is the case, there may be further implications for the case being brought against former President Trump by Special Counsel Jack Smith.
