Jon Justice in the Morning, 9.13.23: Book Bans and the First Amendment

Jon Justice flashed the “bat signal” early Wednesday morning, and asked me to call in to his show to discuss the decision of the Carver County Library Board not to remove a book entitled “Gender Queer” from the library following requests by some to do so. We discussed the applicability of a particular state statute prohibiting the sale or loan of certain materials to minors, and the U.S. Supreme Court’s test for what materials are not protected by the First Amendment, called the “Miller Test”.
